Rent reduction - landlord side

So I was asked for a rent reduction because of the reference interest rate change. But the tenant does not say what the new rent should be, leaving me the choice. What would you do? Use the MV calculator and use that number?

How old is the contract? What was the price index back then or was it even stated in the contract? If it‘s a couple of years old, you might even be able to increase their rent due to higher inflation.

Don‘t give up so quickly. You might be able to twist the situation to your benefit.

If MV means “Mieterverband”, then you may want to consider that you could be the other side. “HauseigentĂŒmerverband” should be able to offer you guidance.

Yes, but my experience with HEV has been terrible and I cancelled my membership. I cannot find a calculator on their website.

Yes, if you stick to what the Mietverband tells you, you should be fine no?

Basically they show the maximum amount a tenant can demand, hence you put it to that value.
Adjusting the rent less than what they tell you might just cause unnecessary trouble (because they can push it further), and adjusting to lower value than they tell, would just mean gifting money to your tenant.

The increase is not always justified. Plus there can be reserves, increase in offsetting costs etc.

You mean decrease or increase? If you use the MV calculator it shows you what can be added on top regarding inflation & general cost increases which is weighted against the reference rate.

Or do you mean the MV calculator does not cover each edge case?

So do you also increase rents according to the reference rate? If not I would ask the tenant that you prefer to leave the rate as it is for as long as the tenant is in the appartment, thats what I do.

Normally the tenant does not need to say what rent should be (in canton ZH atleast)

A simple letter requesting rent review is enough

He is the landlord, not the tenant.

I know. But he was asking why tenant didn’t provide the requested rent. And I was just saying that tenant doesn’t need to do so.

Tenant just need to say „please review my rent“ and then landlord does the math

Well yes, if and when the rate will go up again, I’ll raise the rent.

That is normal, the rent does not only depend on the reference rate but also inflation and maintenance costs. It could actually happen that the rent increases if you request a rent update because of this. The rent reduction is therefore not automatic but of course each element needs to be justified.

And also the inflation index doesn’t seem to match the Swiss CPi

Which is kind of the same as Teuerung/Inflation no?
But for some reason in the case of rents, this is always added on top.

The older the house gets, the higher the maintenance costs, that’s independent of inflation. You need to replace the dishwasher, renovate the roof due to wear and tear.
