Ongoing legal actions against employer after I leave CH

I can increase my own contribution up to 8.0% while the 6.5% from my employer stays the same.

It seems very curious to me that your employer would commit fraud, and then indict themselves by stating their fraud on your salary slips. So I would approach the situation first as either a misunderstanding or a clerical, before assuming fraud.

I recommend that you carefully review your pension plan. There are two possible factors which could create a discrepency between the contributions which you pay, and those paid by your employer:

  • Voluntary contributions. Employers are only legally obligated to match mandatory pension fund contributions. A pension plan can, theoretically, include extra voluntary contributions by you, but not your employer. This arrangement isn’t common, but it’s possible.

  • Voluntary insurance. Here too, if your pension plan includes supplementary disability and survivor’s insurance above what is legally required, your employer is not obligated to cover half of the premiums. This arrangement is common in Switzerland. Many Swiss pension funds offer plans with supplemental insurance, because without it, you are very poorly protected against disabilities resulting from illness. Supplemental premiums of, say, 70 francs per month are not unrealistic.
