I am dealing with a foreign pension which was retroactively withdrawn after 10 years of written statements guaranteeing the pension.
Ombudsman (local, not swiss) decided to not rule - i suspect out of fear about my case creating a major precedent.
i then approached law firm after lawfirm (specialized in pension law) in said country and they all refused to take the case because they were conflicted - ie doing work for the pension fund involved). My take:
- pension funds purposefully spread their legal work across multiple law firms to makr them conflicted
- Law firms may even not be conflicted but prefer to not piss off a major potential client
Pulls the rug out from under your faith in fair legal process.
In the end i slipped to lower tier law firms and finally found one willing to take it on.
Law firms are commercial businesses. Refusing to put their name on the letter must have been for a âgoodâ reason. Commercial or perhaps local community relations.
